1. Operator and acceptance

This website is operated by IE Bastion (“Bastion”, “we”, “us” or “our”), Vechirnii Boulevard, Kryvyi Rih 50000, Ukraine. Contact: mariia@getbastion.cc.

By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website. If you use it for an organisation, you confirm that you are authorised to act for that organisation.

2. Website purpose

The website provides general information about marketplace brand-protection services. It is intended primarily for adults acting in a business or professional capacity. You must be at least 18 years old to submit an enquiry.

Website content and a complimentary Brand Check are general business information, not legal advice. Using the website or sending an enquiry does not create a lawyer-client, fiduciary, agency, or other professional-client relationship.

3. Project enquiries and complimentary Brand Checks

A form submission asks us to contact you about the request. It does not bind either party, create an engagement, or oblige Bastion to conduct a review. We may decline, limit, pause, or discontinue a complimentary review at our discretion, including where information is incomplete, a conflict exists, or a request is outside our scope.

Any review is based on the information and marketplace material reasonably available at the time. Search results and flagged listings are indicators for further assessment, not a legal finding that a listing, product, or seller is unlawful, counterfeit, or unauthorised.

4. Paid services

Paid monitoring, evidence preparation, removal-request management, or related work begins only under a separate written agreement. That agreement controls if it conflicts with these Terms. No website copy, email exchange, estimate, or free review is a promise that a marketplace will remove a listing, suspend an account, or reach a particular decision.

Marketplaces and other third parties apply their own rules and make their own decisions. Evidence availability, rights ownership, marketplace procedures, seller responses, and later relisting can all affect an outcome.

5. Your responsibilities

You agree to:

• provide information that is accurate and that you may lawfully share;
• avoid submitting passwords, payment card data, government IDs, health data, or other unnecessary sensitive information;
• obtain any authority needed before asking us to assess or act for a brand, rights holder, or organisation; and
• independently review important legal or commercial decisions with appropriate professional advisers.

6. Acceptable use

You must not:

• use the site unlawfully, fraudulently, or to infringe another person’s rights;
• submit false ownership, authorisation, infringement, or seller claims;
• interfere with the site, probe its security, introduce malicious code, overload it, or attempt unauthorised access;
• scrape, copy, or republish substantial parts of the site except as allowed by law or our written permission; or
• misrepresent an association with or endorsement by Bastion.

7. Intellectual property

The website design, copy, graphics, compilation, and Bastion branding are owned by or licensed to IE Bastion and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive right to access the site for legitimate internal business evaluation. No other right is transferred.

Names and marks belonging to marketplaces, customers, or other third parties remain the property of their respective owners. Their mention does not imply affiliation or endorsement.

8. Third-party services and links

The site may link to or rely on third-party services, including form, security, hosting, email, marketplace, or professional-network services. Those services have their own terms and privacy practices. We are not responsible for third-party content, availability, rules, or decisions, except to the extent applicable law provides otherwise.

9. Availability and disclaimers

We aim to keep website information useful and current, but the site is provided on an “as available” basis. To the fullest extent permitted by law, we do not warrant that the site will be uninterrupted, error-free, complete, secure, or suitable for a particular purpose. You remain responsible for how you use website information.

10. Liability

To the fullest extent permitted by law, IE Bastion is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising only from use of, or inability to use, this informational website or a complimentary initial review, including lost profits, revenue, opportunity, goodwill, or data.

Nothing in these Terms excludes or limits liability for intent (dolus), gross negligence (culpa lata), fraud or fraudulent misrepresentation, death or personal injury caused by negligence where that rule applies, wilful misconduct, or any other liability that cannot lawfully be excluded or limited under applicable mandatory laws (including German AGB compliance standards, where applicable).

11. Governing law and disputes

These Terms and non-contractual matters arising from them are governed by the laws of Ukraine, without prejudice to mandatory protections that apply under the law of your country. Courts with jurisdiction at the operator’s legal address will have jurisdiction, unless applicable law requires another forum.

Before starting formal proceedings, please contact us so that the parties can try in good faith to resolve the issue.

12. Changes and general terms

We may update the site and these Terms. The revised Terms apply from the effective date shown above and do not retroactively alter a signed service agreement. If any provision is unenforceable, it will be limited or removed only to the minimum necessary, and the remainder will continue. A failure to enforce a provision is not a waiver.
